Art Christiana — Terms & Conditions
Effective date: 10 August 2025
These Terms & Conditions (the “Terms”) govern your access to and use of the website artchristiana.com and purchases made through our online store (the “Store”). By placing an order, you agree to be bound by these Terms.
1) About Us

We sell worldwide. Some rights and remedies differ depending on where you live; regional rules that protect consumers always take precedence over anything in these Terms.
2) Scope & Definitions

Consumer: a natural person acting for purposes wholly or mainly outside their trade, business, craft or profession.

Business Customer: any customer that is not a Consumer.

Products: physical goods offered for sale, including personalised or made-to-order items (e.g., customised icons).

Order Confirmation: the email we send confirming we have accepted your order. A contract is formed only when you receive this Order Confirmation.
Where we provide translations, the English version prevails in case of conflict.
3) Account, Eligibility & Age
You may checkout as a guest or create an account. You must be 18+ (or the age of majority in your country) to purchase. You are responsible for keeping your login credentials secure.
4) Product Information & Personalisation

We strive for accuracy, but minor variations can occur, especially for hand‑finished or personalised items (e.g., tone of wood, leafing, varnish). Such differences do not limit your statutory rights.

For personalised items, we may send proofs for approval. Please review carefully; production starts after your approval. After approval, changes may not be possible.
5) Prices, Taxes & Promotions

Prices shown at checkout are in the currency stated and, for EU deliveries, include VAT where applicable. Shipping costs, import duties and taxes (outside the EU/UK) are shown or explained at checkout.

We may correct obvious pricing errors; if we do so after you order, you can cancel for a full refund before dispatch.

EU/EEA price reductions: where we display a discount, the prior price refers to the lowest price in the last 30 days unless a different disclosure is required by law.

Promo codes and gift cards are subject to stated conditions and validity. One code per order unless stated otherwise.
6) Ordering Process & Contract Formation

Adding Products to the cart and submitting an order constitutes an offer to buy.

You will receive an automatic acknowledgment email. The Order Confirmation we send afterwards is our acceptance and forms the contract.

If an item is unavailable or we cannot accept your order, we will inform you and issue a refund if payment was taken.

We recommend you keep a copy of the Order Confirmation for your records.
7) Payment Methods (Shopify Payments & Bank Transfer)

We accept major cards and local payment methods via Shopify Payments. Transactions in the EEA/UK may require Strong Customer Authentication (e.g., 3‑D Secure). We do not store full card details.

Bank Transfer (Manual): available at checkout. Your order will ship after we receive cleared funds. Please include your Order Number in the transfer title. We may cancel unpaid transfer orders after 7 business days. Any bank charges or currency conversion fees are your responsibility.

We may use third‑party anti‑fraud tools and decline or cancel an order if fraud is suspected.

Refunds are processed to the original payment method where possible.
8) Shipping & Delivery (UPS / FedEx)

We ship with UPS and FedEx to most countries. Available options, costs and estimates are shown at checkout. We provide tracking where available. We do not ship to P.O. boxes where carriers do not support them.

Customs & Duties (outside EU/UK): unless stated otherwise, shipments are sent DAP – Delivered At Place. Import duties, taxes and fees are collected by your local carrier/authority and are payable by you. Refusing a delivery does not void these charges; deductions may apply to refunds for uncollected or refused shipments.

Delivery timeframes are estimates only. We are not responsible for delays outside our control (e.g., customs, weather, strikes); we will work with the carrier to minimise disruption.

Risk & Title: risk passes on delivery to your address (or to the person you nominated). Title passes when we receive full payment.

Please inspect parcels upon delivery and note any visible damage with the courier where feasible. Report delivery issues to us as soon as reasonably possible.
9) EU/UK Consumers — Right to Withdraw (14 Days)
If you are an EU or UK Consumer, you have the right to withdraw from a distance contract within 14 days without giving any reason.
How to exercise: notify us before the 14‑day period expires (email is sufficient). You may use the Model Withdrawal Form in Annex A but it is not mandatory.
Returns after withdrawal:

You must send back the goods without undue delay and in any event within 14 days of telling us you are withdrawing.

Return shipping costs are borne by you unless we agreed otherwise or failed to inform you in advance.

We refund all payments including the cost of our least expensive standard delivery offered, within 14 days of receiving your notice; we may withhold the refund until we receive the goods or evidence of having sent them back.

You are liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Exceptions: no right of withdrawal for custom‑made or clearly personalised products and other exceptions provided by applicable law.
This section does not affect any additional rights you may have under local law.
10) Returns Policy — Non‑EU/UK Customers
For customers outside the EU/UK, we offer a 30‑day voluntary return policy from delivery on unused, resalable products (original packaging), excluding personalised items.

Contact us before returning. You are responsible for return shipping costs, customs declarations and any import fees on return shipments.

Refunds exclude original shipping costs unless the item was faulty or we made an error.

Exchanges are processed as a new order after the refund.
Your mandatory rights under local consumer law remain unaffected where they apply.
11) Faulty or Non‑Conforming Products

EU/EEA & UK Consumers: you benefit from a legal guarantee of conformity (typically 2 years for physical goods). If a product does not conform, contact us; we will provide appropriate remedies such as repair, replacement, price reduction or refund, in accordance with applicable law.

Other regions (incl. USA): remedies are provided to the extent required by applicable law. To the maximum extent permitted, we exclude implied warranties not mandated by law. This does not affect non‑excludable rights.
To start a claim, email support@artchristiana.com with your order number, description and photos where helpful. We aim to respond within 14 days.
12) Reviews, Incentives & User‑Generated Content (UGC)
Authenticity & verification. We invite reviews only from customers who purchased the product (via post‑purchase emails or account prompts). We may ask for proof of purchase.
Incentives disclosure. Where a reviewer received an incentive (e.g., a 5% discount code for submitting a review), we clearly disclose this alongside the review.
Prohibited conduct. Fake or misleading reviews, undisclosed sponsored content, and infringing or unlawful material are not allowed.
Licence. By posting UGC (text, photos, videos), you grant us a non‑exclusive, royalty‑free, worldwide licence to host, display and reproduce your content for the purpose of operating and promoting the Store. You retain ownership of your content.
Moderation & reporting (DSA). We may remove or restrict UGC that is unlawful or violates these Terms (e.g., hate speech, IP infringement, privacy violations, spam).

How to report: email shop@artchristiana.com with the URL, description and legal basis (if any). We will acknowledge receipt and inform you of our decision with reasons and available remedies.

We publish periodic transparency information about content moderation actions where required by law.
13) Intellectual Property
All content on the Store (including images, product descriptions, designs and trademarks) is owned by or licensed to us and is protected by intellectual property laws. You may not use our content without prior written consent.
14) Liability
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
To the maximum extent permitted by law, we are not liable for: (a) indirect, incidental or consequential losses; (b) loss of profit, revenue, data, or business; (c) delays outside our reasonable control. Consumers retain all mandatory rights and remedies under applicable law.
15) Force Majeure
We are not responsible for any failure or delay caused by events beyond our reasonable control (e.g., natural disasters, war, sanctions, epidemics, strikes, carrier or utility failures, government actions). We will take reasonable steps to minimise the effects.
16) Governing Law & Jurisdiction
These Terms are governed by Polish law, without prejudice to mandatory consumer protection rules in your country of residence. Consumers may bring proceedings in the courts of their habitual residence. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
17) Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on the Store and, where changes are material, notify registered customers by email at least 14 days before they take effect. Orders accepted before the effective date remain governed by the previous Terms.

Annex B — How to Return

Email shop@artchristiana.com with your order number and the items you wish to return.

Pack items securely in original packaging where possible. Include your order number in the parcel.

Use a tracked service. Keep proof of postage.

On receipt and inspection, we process your refund to the original payment method.
